Compliance

According to Article 17 of the Convention, the Conference of the Parties shall develop and approve procedures and institutional mechanisms for determining non-compliance with the provisions of the Convention and for the treatment of Parties found to be in non-compliance. 

To prepare draft procedures on non-compliance for its consideration, the Conference of Parties established an ad hoc open-ended working group on non-compliance that met in April 2006 and April 2007. Further work on the issue was undertaken by the Conference of the Parties at its third, fourth, fifth, sixth, seventh and eighth meetings. At its eighth meeting, and as reflected in paragraphs 215-222 of the meeting report, the Conference of the Parties decided to defer further consideration of the matter of compliance to its ninth meeting.

The table below sets out comments on outstanding issues submitted by Parties at the invitation of the Bureau during the intersessional period between the seventh and eight meetings of the Conference of the Parties.

3. Requests the Secretariat to prepare, for submission to the open-ended ad hoc working group, the following:

(a) A compilation of the views and proposals submitted to it pursuant to paragraph 2;

(b) A draft text of procedures and institutional mechanisms on non-compliance under Article 17, reflecting different options and alternatives, on the basis of the views and proposals above and bearing in mind recent developments concerning compliance within multilateral environmental agreements.

Those documents should be made available as soon as practicable but not later than 2 months before the second meeting the Conference of the Parties;

4. Requests the open-ended ad hoc working group to report on its work to the Conference of the Parties at its second meeting, including any recommendations, for consideration by the Conference of the Parties.

1. Welcomes the report of the meeting of the open-ended ad hoc working group to consider procedures and institutional mechanisms on non-compliance which was held on 28 and 29 April 2006 in Geneva, 2. Decides, in view of the recommendation contained in the report of the openended ad hoc working group, to convene for a duration of three days immediately prior to the third meeting of the Conference of the Parties a second meeting of the openended ad hoc working group to consider procedures and institutional mechanisms on non-compliance under article 17 of the Convention; 3. Also decides to consider further the matter required under Article 17 of the Convention with the aim of reaching agreement on procedures and institutional mechanisms on non-compliance at its third meeting, if possible; 4. Further decides that the draft text contained in the annex to the report of the meeting of the open-ended ad hoc working group shall be the basis for further work of the open-ended ad hoc working group at its second meeting and subsequent discussion at the third meeting of the Conference of the Parties on the question of non-compliance;

The Conference of the Parties

1. Decides to consider further at its sixth meeting for adoption the procedures and institutional mechanisms on non compliance required under Article 17 of the Convention;
2. Decides also that the draft text set out in the annex to decision SC-4/33, bearing in mind the proposal of the chair of the contact group set out in the appendix to that annex, shall be the basis for its further work on the procedures and institutional mechanisms at its sixth meeting;
